1. Acceptance of Terms

Welcome to JNNK ("JNNK," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, online store, social media pages, physical retail locations, pop-up events, and any related services (collectively, the "Services"). JNNK is based in Los Angeles, California.

By accessing or using our Services — including browsing our website, creating an account, making a purchase, attending an event, or otherwise interacting with our brand — you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not access or use our Services.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services. If you are under 18, you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Products, Pricing, and Availability

  • All product descriptions, images, and pricing are subject to change without notice.
  • Many of our products are vintage, reworked, upcycled, or one-of-a-kind items. As such, sizing, condition, and measurements may vary from standard retail sizing (see our Sizing Guide). We do our best to accurately describe and photograph all items, but minor variations in color, fabric, and condition should be expected as part of the nature of vintage and handmade goods.
  • We reserve the right to limit quantities, refuse service, or cancel orders at our sole discretion, including in cases of suspected fraud, pricing errors, or violations of these Terms.
  • Payment must be made in full at the time of purchase through our approved payment processors. We do not store your full payment card information.

4. Returns, Exchanges, and Refunds

All sales of vintage, reworked, or one-of-a-kind items are treated as final sale unless otherwise stated at the time of purchase or required by applicable law. Please refer to our separate Returns & Exchanges Policy for full details. Nothing in that policy or these Terms limits any non-waivable rights you have under California consumer protection law.

5. Intellectual Property; Name, Logo, and Likeness Protection

5.1 Ownership

All content associated with JNNK — including but not limited to the JNNK name, logo, wordmarks, trade dress, product designs, garment designs, photography, videography, graphics, website layout, social media content, marketing materials, and written content (collectively, the "JNNK IP") — is the exclusive property of JNNK and/or its licensors, and is protected under U.S. and international copyright, trademark, and other intellectual property laws.

5.2 Limited License to Users

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Services and JNNK IP for your own personal, non-commercial use. This license does not include the right to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the JNNK IP for any commercial purpose without our express written consent;
  • Use the JNNK name, logo, or any confusingly similar mark in connection with any product or service in a manner likely to cause confusion;
  • Use any automated system (bots, scrapers, data-mining tools) to extract content or data from our Services;
  • Modify, create derivative works from, or reverse-engineer any part of the Services or JNNK IP.

5.3 Unauthorized Use of Our Name or Likeness

JNNK actively protects its brand identity. Any unauthorized use of the JNNK name, logo, designs, or associated likeness — including counterfeit merchandise, unauthorized resale using our branding, impersonation of official JNNK accounts, or use of our marks in advertising or domain names without permission — is strictly prohibited and may result in legal action, including but not limited to claims for trademark infringement, unfair competition, and damages.

5.4 User-Generated Content

If you submit, post, or send us any content (including photos, reviews, testimonials, tags, or social media posts referencing JNNK), you grant JNNK a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that content in connection with our business, marketing, and Services, in any media now known or later developed, without additional compensation or notice to you. You represent that you own or have the necessary rights to grant this license and that your content does not infringe any third party's rights.

6. Publicity and Use of Customer Likeness

By attending JNNK events, pop-ups, or photo shoots, or by tagging or interacting with JNNK on social media, you acknowledge that JNNK may photograph or film such events and may use your image, likeness, or voice captured in such content for promotional and commercial purposes without additional compensation, unless you notify us in writing in advance that you do not consent.

7. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms;
  • Harass, threaten, defame, or abuse JNNK staff, other customers, or the brand, whether in person, online, or via customer service channels;
  • Submit false or fraudulent orders, chargebacks, or payment disputes without valid basis;
  • Interfere with or disrupt the security or functionality of the Services;
  • Impersonate JNNK, its employees, or affiliates;
  • Engage in counterfeiting, unauthorized reselling using our brand assets, or any activity that infringes our intellectual property rights.

Violation of this section may result in, among other remedies, termination of your access to the Services and pursuit of legal action.

8. Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PRODUCT WILL MEET YOUR EXPECTATIONS. GIVEN THE VINTAGE AND UPCYCLED NATURE OF MANY OF OUR PRODUCTS, WE MAKE NO WARRANTY REGARDING THE LONGEVITY, DURABILITY, OR CONDITION OF ANY GARMENT BEYOND WHAT IS EXPRESSLY STATED AT THE TIME OF SALE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JNNK, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, REGARDLESS OF THE LEGAL THEORY ASSERTED (CONTRACT, TORT, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL JNNK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR ANY PRODUCT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO JNNK FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless JNNK, its owners, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content or material you submit, post, or transmit through the Services.

11. Dispute Resolution; Binding Arbitration; Class Action Waiver

11.1 Informal Resolution First

Before filing a claim against JNNK, you agree to first contact us at [insert contact email] and attempt in good faith to resolve the dispute informally for at least 30 days.

11.2 Binding Arbitration

If a dispute is not resolved informally, you and JNNK agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration shall take place in Los Angeles County, California, unless you and JNNK agree otherwise.

11.3 Class Action Waiver

YOU AND JNNK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims.

11.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to [insert contact email] within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out of arbitration.

11.5 Governing Law

These Terms and any dispute arising from them shall be governed by the laws of the State of California, without regard to its conflict-of-law principles, except where superseded by applicable federal law. Subject to the arbitration provisions above, you agree that any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, third parties, or our business interests, or for any other reason at our sole discretion.

13. Third-Party Links and Services

Our Services may contain links to third-party websites, marketplaces, or social media platforms not owned or controlled by JNNK. We are not responsible for the content, policies, or practices of any third-party sites. Your interactions with any third party found through our Services are solely between you and that third party.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will otherwise remain in full force and effect.

15. Entire Agreement; Waiver

These Terms, together with our Privacy Policy and any other legal notices published on our Services, constitute the entire agreement between you and JNNK regarding the Services and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, sale of assets, or by operation of law.
